What is CCPA?
The California Consumer and Privacy Act (CCPA) with an effective date of January 1, 2020 provides California residents notice, access, and control of their personal information. CCPA provides California residents the right to request a business to disclose the categories and specific pieces of personal information that it collects about the resident, the categories of sources from which that information is collected, the business purposes for collecting or selling the information, and the categories of third parties with which the information is shared. How does CCPA Impact Terminus Customers?
Terminus’ service and product offerings is business to business (B2B) and not with individual consumers. The Legislature added a B2B exemption in the CCPA law for one year. However, this exemption does not apply to the right to opt-out of the sale of personal information, the obligation not to discriminate against a consumer for attempting to exercise other rights, or the private right of action in the event of a data breach. While Terminus does not sell business contact information as defined by CCPA, we are actively monitoring the law, reviewing potential changes, and working diligently to prepare and comply. How does CCPA Impact Terminus Marketing Website Visitors?
Terminus uses cookies to allow website visitors to access or use our services, to market and advertise our services and products, and to navigate through the pages of our website to ensure website visitors get the best experience. Terminus may also use a web beacon (or clear gif) technology to help us understand website visitor web browsing interest on our websites and interaction with our email marketing communications. This may fall under the definition of “sale” of information under the original language of CCPA. This “sale” of information is not part of service and product offerings to our customers, but rather applies only to our marketing websites and our own use of cookies for website visitors. Therefore, a, ‘Do Not Sell My Personal Information’ link is on our marketing websites. We will continue to monitor developments on this issue as well.
Is Terminus CCPA Ready?
Yes. Here’s what we’ve done to prepare for and comply with CCPA:
- Conducted a privacy impact assessment across our organization
- Identified all areas where information is sold
- Updated our internal policies to include language for CCPA
- Updated our terms of service and data processing addendum to include provisions for CCPA
- Developed a process for responding to and handling data subject requests
- Implemented a ‘Do Not Sell My Personal Information’ link on our main websites and in our privacy policy (effective January 1, 2020).
How is Terminus Processing Data We Receive from Individuals to our Marketing Website Under CCPA?
Terminus may collect personally identifiable information that visitors to our website voluntarily provide to us when contacting us with questions regarding our service, requesting a demonstration of our product, creating a user account for our products and services, requesting newsletters, or applying for a position with us.
How is Terminus Processing Data We Receive from Our Customers Under CCPA?
Terminus is primarily only processing account-level data from customers (who are entities, not individuals) to perform the account-based marketing service. Terminus intentionally minimizes the processing of personal data as an account-based solution.
